At the outset, we have no objection to the planned soil testing <br />scheduled on the Morgan property for November 22 through approximately <br />December 2, as referenced in the recent email from counsel for Western Fuels <br />Colorado, LLC ( "WFC "). Representatives of the Morgan family will plan on <br />attending. <br />However, the Morgan family has continuing objections to the legality and <br />content of Permit Revision Number 6. Those objections are currently stayed <br />while the investigations mandated by Office of Surface Mining and the Division <br />of Reclamation, Mining & Safety are carried out. The Morgan family has asked <br />me to reiterate on their behalf that their agreement with the Soil Sampling and <br />Analysis Plan as contemplated by TR -61 is not to be construed to be an <br />admission as to the suitability of any reclamation plans offered by WFC in PR -6. <br />In doing so we are relying in part on the statement by WFC representative Ben <br />Langenfeld in the review comment correspondence to DRMS, dated October 20, <br />2011, stating: <br />"the SAP laid out in TR -61 is designed to, gather data for the purpose of <br />determining the best practices going forward in reclaiming the Morgan <br />Property prime farmland..TR -61 is not intended to begin this reevaluation.." <br />
