Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has performed a preliminary <br />adequacy review of Amendment 04 to your 112 construction materials the reclamation permit <br />application. The application was received on August 29, 2011 and called complete for the <br />purpose of filing on September 12, 2011. The decision date for this application is set by Rule <br />1.4.8 to be 90 days after the filing date. The two -day delay in publishing the legal notice <br />(September 24, 2011, instead of September 22, 2011) does not affect the Division's decision <br />date. Therefore the decisions date is still December 12, 2011. Please be advised that if you are <br />unable to satisfactorily address any concerns identified in this review before the decision date, it <br />will be your responsibility to request an extension of the review period. If there are <br />outstanding issues that have not been adequately addressed prior to the end of the review period, <br />and no extension has been requested, the Division will deny this application. <br />This preliminary adequacy review is based on: a) the Division's review of the proposed drainage <br />easement improvements between Highway 50 and the expanded affected area proposed in the <br />Amendment application, and b) the October 28, 2011 field inspection and discussions with the <br />applicants. <br />The Division believes the proposed drainage improvements within the existing 150 -foot drainage <br />easement are not directly related to the mine operation.
