2010 Annual Reclamation Report Review

STATE OF COLOFADO
The Division has completed its review of the above referenced report received on 19 October 2011. The
Division finds the 2010 Annual Reclamation Report is in compliance of the following Rules:
Rule 2.04.13(1) — The ARR was received 19 October 2011.
Rule 2.04.13(1)(a) —The cover of the ARR includes the name of the permittee, the address and the
permit number.
Rule 2.04.13(1)(c) — No disturbed acres were backfilled during calendar year 2010.
Rule 2.04.13(1)(d) — No disturbed acres were topsoiled during calendar year 2010.
Rule 2.04.13(1)(e) — No disturbed acres were revegetated during calendar year 2010.
Rule 2.04.13(2) — The following additional monitoring information was provided: weed control activities
and minor erosion repairs were conducted in 2010.
The Division finds the 2010 Annual Reclamation Report appears to not be in compliance of the
following Rule:
Rule 2.04.13(1)(b) — Iterated in Kent Gorham's 2009 Annual Reclamation Report letter, dated 15 March
2010, and 2009 Revised Annual Reclamation Report letter, dated 6 October 2010, that two technical
revisions to the permit were approved in 2009; TR -50 which incorporated the two Apache Canyon
ventilation shafts back into the New Elk permit area, and TR -51 which approved the excavation at the
West Mine to repair a collapsed portal slope. TR -50, as approved, increased the mine disturbed area
total by two (2) acres and TR -51 increased the disturbed acre total by .5 acre. Please add 2.5 acres to the
"long -term mining or reclamation facility" category on the ARR from if these disturbances were in fact
created (attached are the two letters).
As a reminder, February 15 is the approved date of submission of the Annual Reclamation Report
based on Rule 2.04.13.
Please re- submit the corrected information, as noted above, within thirty (30) days. If you have any
