Marshall <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Dear Mr. Marshall: <br />Re: Oldcastle SW Group, Inc. dba United Companies of Mesa County, Craig Ranch Pit (Permit <br />No. M- 1986 -002) (CHS #59561) <br />Thank you for your correspondence dated September 2, 2011 (received by our office on <br />September 9, 2011) regarding the subject project and for answering our questions on September <br />27, 2011 regarding the need for this follow -up consultation. As project design modifications <br />require a realigned access road (and as this design revision post -dates our original May 6, 2011 <br />consultation letter) we are pleased to provide additional comment. <br />A search of the Colorado Cultural Resource Inventory database indicates that at least one <br />cultural resource inventory has been conducted near the proposed project area and one historic <br />property is located nearby. Site 5ME246 was recommended in 1975 as needing additional data <br />to permit eligibility assessment to the National Register of Historic Places (NRHP). We <br />recommend that the operator avoid this sites or that additional inventory be conducted to <br />determine the effect of the proposed project on these resources. If site avoidance is not <br />possible, we recommend further consultation with our office in order to identify options to <br />avoid, minimize, or mitigate the adverse effect to the sites. <br />Please note, that it appears from our documentation that portions of this project area may <br />fall on land administered by the Bureau of Land Management Grand Junction Field Office. <br />In the event there is Federal agency involvement (such as permitting or oversight), please <br />note that it is the responsibility of the Federal agency to meet the requirements of Section <br />106 of the National Historic Preservation Act as set forth in 36 CFR 800 ( "Protection of <br />Historic Properties "). This includes the identification of any historic properties (i.e. cultural <br />resources which are eligible to be listed in the National Register of Historic Places) within <br />the area of potential effects and determining whether the undertaking will have an effect <br />upon such properties. The State Historic Preservation Office, Native American tribes, <br />representatives of local governments, and applicants for Federal permits, licenses or other <br />approval are entitled to consultative roles in this process. <br />HISTORY COLORADO CENTER 1200 BROADWAY DENVER CO 80203 <br />
