Hernandez, Senior Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: New Elk Mine (Permit No. C- 1981 -012) <br />Minor Revision Application No. 95 (MR -95) <br />Fine Slurry Return Wells <br />The Division of Water Resources (DWR) has reviewed the above - referenced New Elk Mine minor <br />revision application received by the Division of Reclamation, Mining and Safety (DRMS) on August 25, <br />2011. The application proposes to drill three fine slurry return wells, to be used for the disposal of <br />refuse fines into the abandoned mine workings. New Elk Mine is an underground coal mining operation <br />located approximately 25 miles west of Trinidad, CO on land within the Maxwell Land Grant, Las Animas <br />County. <br />On the behalf of New Elk Mine, Ms. Susan Wyman of Whetstone Associates has submitted applications <br />for permits to drill the three fine slurry return wells, in addition to an application to permit the existing <br />recovery well for the pumping of clear water from the abandoned mine workings for non - consumptive <br />coal slurry production. The said applications will be reviewed and evaluated by this office in cooperation <br />with the Division 2 Office in Pueblo, who will work directly with Ms. Wyman on permitting the wells. <br />Therefore, this office has no additional comments so long as the operator and /or the operator's <br />consultants continue to work with the Division of Water Resources on permitting the subject structures. <br />Thank you for the opportunity to comment on this application.
