The application proposes to drill three fine slurry return wells, to be used for the disposal of
refuse fines into the abandoned mine workings. New Elk Mine is an underground coal mining operation
located approximately 25 miles west of Trinidad, CO on land within the Maxwell Land Grant, Las Animas
County.
On the behalf of New Elk Mine, Ms. Susan Wyman of Whetstone Associates has submitted applications
for permits to drill the three fine slurry return wells, in addition to an application to permit the existing
recovery well for the pumping of clear water from the abandoned mine workings for non - consumptive
coal slurry production. The said applications will be reviewed and evaluated by this office in cooperation
with the Division 2 Office in Pueblo, who will work directly with Ms. Wyman on permitting the wells.
Therefore, this office has no additional comments so long as the operator and /or the operator's
consultants continue to work with the Division of Water Resources on permitting the subject structures.
Thank you for the opportunity to comment on this application. If you have any further questions
regarding this matter, please feel free to contact me directly at this office or contact the local Water
Commissioner.
