Box 105 <br />Atwood, CO 80722 <br />RE: Reese -Logan Sand and Gravel Pit; DRMS File No. M- 1996 -050; Consent Agenda Summary Form <br />Mr. Reese, <br />The increase in financial warranty associated with the approval of AM01, as stated in the amendment approval <br />letter to the operator dated February 16, 2010, was not posted within 365 days and still has not been received by <br />the Division. A Board hearing is now required to comply with Construction Materials Rule 4.1(2) as described on <br />the included Summary Form. Enclosed you will find a Staff Summary Form for a Consent Agenda item for the <br />required Mined Land Reclamation Board Hearing. If you do not wish to contest the issue, and will comply with <br />the corrective action required, please sign and notarize the enclosed form and return the signed original copy no <br />later than September 7 2011. By utilizing the Consent Agenda you will not be required to be present at the <br />September 14 -15, 2011 Mined Land Reclamation Board hearing. <br />Before the Board can re- affirm the Division approval of AM01, and set a new date for the submittal of the bond, <br />you are also required to re- notice all parties in accordance with Rule 1.6 including county commissioners, soil <br />conservation district, surface owners of affected land, property owners within 200 feet of affected lands, and <br />republish the public notice in the paper no later than August 26, 2011. You must provide proof to the Division <br />(certified mail tags will work) that this has been completed no later than September 7 2011. <br />Please review the Consent Agenda Summary Form.
