Hickenlooper <br />Governor <br />Dear Ms. Hatcher: <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RECEIVEn <br />1L282o =1 <br />Division or r■e(AiAil , <br />Mining and Safety <br />This letter is in response to your letter dated April 6, 2011, requesting an amendment to <br />the approval of the Geisert Pit Substitute Water Supply Plan ( "SWSP ") dated March 7, 2011. <br />The purpose of this amendment is to include an additional operational depletion associated with <br />the construction of a slurry wall at the Geisert Pit site. All other consumptive uses and conditions <br />at the Geisert Pit site will remain the same as in the May 7, 2011 approval. <br />Weld County proposes to use approximately 41.1 acre -feet from the Geisert Pit for the <br />slurry wall construction, which is expected to begin in July 2011 and is expected to be <br />completed by December 2011. The attached amended Table 2 shows the anticipated depletions <br />associated with slurry wall construction. Water used for slurry wall construction is considered to <br />be 100% consumptive. <br />The source of replacement water for the additional depletion is a lease of 41.1 acre -feet <br />of reusable effluent from the City of Greeley's Wastewater Treatment Plant ( "WWTP "). Weld <br />County has a perpetual lease with the City of Greeley for the right to use up to 300 acre -feet per <br />year of Greeley's reusable effluent. A copy of the lease agreement with the City of Greeley for <br />41.1 acre -feet of fully consumable effluent from the WWTP (WDID 0302312) to be used at the <br />Geisert Pit from July 2011 through December 2011 is attached to this letter. Greeley's WWTP <br />discharge point is located approximately two miles downstream of Weld County's Geisert Pit. <br />There are no intervening water rights within this reach, thus the replacement water from the <br />WWTP is sufficient to replace the pit's out -of- priority depletions.
