Box 535 Somerset, Colorado 81434 USA Tel (970)929 -5122 Fax <br />(970)929 -5177 <br />July 25, 2011 <br />Mr. Brock Bowles <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Oxbow Mining LLC, Permit No. C -1981 -022 <br />PR -06 Application for a Permit Revision. <br />Dear Mr. Bowles, <br />The purpose of this letter is to request Permit Revision No. 06 to the Oxbow Mining LLC <br />(OMLLC) Permit No. C- 1981 -022. This PR provides for the modification of the approved <br />Permit Area to provide for the impending addition of 1) the 156.77 acre federal lease COC- <br />61357 Tract 5 modification area and 2) the 789.79 acre COC -70615 for the new Elk Creek East <br />Federal coal lease area. Please see the attached Map 2.05 -M2, Sheet 1 of 2, Elk Creek Mine, 5- <br />Year Mining Plan for details of the area. <br />Permit Area Modification <br />Oxbow proposes to expand the Permit area by 2,247.43 acres. All of the acres are Federal acres. <br />We are also proposing to eventually add an additional 946.56 acres of Federal coal lease areas <br />within the expanded Permit area footprint. We do not propose any additional mining activities <br />for those areas exceeding the Federal coal lease areas. The map 2.05 -M2 also summarizes the <br />proposed mineplan for the Federal coal lease areas. <br />156.77 Acre Federal lease modification COC -61357 Tract 5 <br />Oxbow submitted the Tract 5 Lease modification package to the BLM on June 1, 2010. Since the <br />Tract 5 area is located on lands managed by the USFS, they are responsible for conducting the <br />NEPA analysis. We understand that the Environmental Analysis (EA) was recently concluded by <br />local GMUG Forest Service personnel as of the end of July 2011. The EA will be forwarded for <br />further review to the Washington D.C. Office of the Secretary of Agriculture for a second review <br />of roadless considerations. We anticipate the lease modification process will be concluded in <br />August 2011 and BLM will then conclude the lease modification process shortly thereafter.
