RE: Colowyo Coal Mine, C1981 -019, Permit Revision No. 3, Third Adequacy Review Letter
Dear Mr. Blunt:
The Division found Colowyo Coal Company, LLC's (CCC) application for a Permit Revision (PR3)
for mine expansion and mining in the Collom area complete on December 27, 2010. The Division
reviewed the application and provided CCC with a preliminary adequacy review on February 25, 2011.
CCC responded to the Division's preliminary adequacy concerns on March 28, 2011. The Division
reviewed CCC preliminary adequacy review responses and provided a second adequacy letter on April
22, 2011. CCC provided a second adequacy review response on May 23, 2011. The Division has the
remaining adequacy concerns as a result of our review of the second set of adequacy responses.
For the record, the original questions have been restated. The Division's review of CCC's first
adequacy response is in blue text. The Division's determination of CCC's response: adequate or
additional information required, is stated in gray text.
2.03.6 - General Requirements
1. On Rule 2 page 2, CCC makes the statement that "unleased and unassigned federal coal for
Little Collom X pit area is pending ". Since submitting the application, CCC personnel have
informed the Division that the permittee will not be acquiring this unleased coal. Rule
2.03.6(1) does not allow the Division to permit a mine plan the operator has not obtained the
right of entry. Please revise this paragraph to remove this statement.
CCC has removed the statement regarding unleased Federal Coal on Rule 2, page 2. This
response is acceptable.
