DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Phone: (303) 866 -3567 <br />FAX: (303) 832 -8106 <br />July 13, 2011 <br />Jerry Nettleton <br />Twentymile Coal Company <br />29515 Routt County Road No. 27 <br />Oak Creek, CO 80467 <br />RE: Foidel Creek Mine, Permit C -82 -056 <br />Second Quarter 2011 Coal Waste Pile Inspection Report <br />Dear Mr. Nettleton, <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) have found the above <br />referenced report to be in compliance with CDRMS Regulations: 4.09.1(11) and 4.10.2(2). <br />The above referenced report was prepared by North West Colorado Consultants (NWCC) for <br />Twentymile Coal Company. NWCC visited the site on May 27, 2011 and on June 30, 2011. Based on <br />the report, NWCC noted shallow erosion channels on the lower bench on the east side of the refuse <br />pile that should be addressed in order to curb further erosion. No signs of instability, structural <br />weakness or hazardous conditions at the refuse pile. The report states that the wash plants produced <br />approximately 151,242 tons of waste coal. On May 27, 2011 a total of four compaction tests were <br />conducted at the Expansion Area. All tests met the minimum compaction requirement of 90% of the <br />maximum standard Procter density. <br />As of the date of the report, no new stripping of topsoil and cover materials was conducted and no new <br />haul road construction had taken place. <br />Please note that the erosion identified in the report have yet to be repaired. It is NWCC's <br />recommendation that these small gullies be repaired to prevent further down cutting and erosion <br />of the pile. <br />If you have any questions feel free to contact me.
