Pineda <br />Director <br />On June 7, 2011 the Division of Reclamation, Mining and Safety (Division) received your <br />request for a Technical Revision (TR3) to permit no. M- 1990 -057. During review of the <br />information submitted for TR3 and the permit file for this site, it was noted that a designated <br />chemical, potassium amyl xanthate, is used and /or proposed to be used in extractive <br />metallurgical processing at the site. Therefore, pursuant to Rule 7.2.2, you are hereby notified <br />that your operation may be a Designated Mining Operation <br />According to Rule 7.1.3(2), all Designated Mining Operations shall submit to the Division an <br />Environmental Protection Plan (EPP) for review and approval. <br />If the Operator agrees with the Division that the operation is a Designated Mining Operation, the <br />Operator shall notify the Division of the Operator's concurrence, by mail, within 30 days of the <br />date of this notice and proceed to comply with the requirements of Rule 7.2.3. <br />Please feel free to contact me, should you have any questions or concerns regarding this matter. <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
