The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the Varra
Companies, Inc. 112c amendment application adequacy response dated July 5, 2011 for the Varra
Resources Project 110, File No. M- 1984 -036, and submits the following comments. The Division is
required to make an approval or denial decision no later than July 27, 2011 therefore; a response
to the following adequacy review concerns should be submitted to the Division as soon as possible.
1. The Applicant did not respond to the comments submitted by the Colorado Division of Water
Resources, Colorado Historical Society, and the Corps of Engineers. Please address the
comments noted in the letters and make any changes to the application.
2. Rule 6.2.1(2) requires maps be signed by a registered land surveyor, professional engineer, or
other qualified person. The copy of Exhibit C-1 — Ownership & Structures Notifications Map
submitted on July 6, 2011 was not signed. Please resubmit a signed copy of the map.
6.4.18 Exhibit R - Proof of Filing with County Clerk and Recorder
3. Please provided an affidavit or receipt indicating the date on which the revised application was
placed with the local County Clerk and Recorder for public review, pursuant to Subparagraph
1.6.2(1)(c).
Please note: the subject line of the Statement of Understanding between Varra Companies, Inc.
and the St. Vrain Sanitation District indicates the incorrect site name (Heintzelman Project) and the
Weld County Public Works Department letter submitted with the July 5, 2011 response pertains to
the Western Sugar site.
Please be advised the Varra Resources Project 110 amendment application may be deemed
inadequate, and the application may be denied on July 27, 2011, unless the above mentioned
adequacy review items are addressed to the satisfaction of the Division. If more time is needed to
complete the reply, the Division can grant an extension to the decision date. This will be done
