11/09/2010 15:20 FAX 870 865 2675 VISTA REALTY [a 0011002 <br />� <br />BEFORE THE MINED LAND RECLAMATION BOARD STATE OF COLORADO <br />This is in response to Western Fuels objection to an extension filed by JoEllen Turner and <br />Michael Morgan_ <br />First o££, we did not get a written notice for the pre - conference hoaxing and be able to pre pare for <br />that until just a few minutes prior to the hearing_ In fact, I had to chase the Federal Express man <br />down and meet him at the power plant to even receive the notice and read what it would accept. <br />And Western Fuels was given the opportunity to present documentation that was not factual to <br />the pre - conference hearing officer which we were not and in fact we had no address, no -email, no <br />phone number, or no fax number even if we had received the information sooner. <br />The pre conference hearing set a tentative date of the 8' and would give us in writing what we <br />would be able to present and what infiormatiozr and exhibits would be permitted. This is a small <br />town and it has no facilities of any coping in this place whats so ever for 15 sets and on <br />weekends and Fridays any plane that might be able to assist close on Fridays early. The one real <br />estate place that we have could not even help me because they were closed on Saturday and <br />Sunday. And then there is no federal express or postal facility available to even get it in the mail. <br />We are objecting to the extension of the time for public comment because it has been stated that <br />the witnesses need to address PR-06 and none of these employees have read PR and the issues <br />that will be addressing what the value that the mine or power plaint is to this community and the <br />value of their jobs. This is an economic depressed area and we love our coal powered power <br />plant. And everyones job is valuable and their livelihoods are valuable as is ours. If we have to <br />stick to the contents of PR-06, we believe that Western Fuels employees should have to stick to <br />the specifics of PR -06. PR-06 has nothing to do with any of those items_ We have been out of <br />production for 10 years now and this farm is our livelihood and the agricultural productivity of <br />these farms is for a life time in this area. We were the only farm that was a cash crop only and <br />our jobs are just as important and this farm being returned to its full production that it was prior <br />to mining is just as important. We are not the ones that have caused this, the mine has. <br />Returning our property to as good as or better than it was and returning our prime soils to us that <br />were there is what the Colorado Regulatory Program is suppose to be about. Western Fuels, sent <br />as letter to all of my witnesses scaring and intimidating them by accusing All of these teachers <br />here as being dishonorable. The ruiners are laid off of work right now because the power plant is <br />shut down and has Nothing to do with PR-06 and nothing to do with us. There has only been <br />even a couple of employees that even carne to the informal hearing and there has been no <br />documented letter at the court house as a result of that hearing that addressed issue raised or in <br />favor of PR -06. The only letters that are at the court house are objection letters. The way this <br />property is being returned to us has nothing to do with their jobs and the value of their jobs. <br />There has been a request for another formal hearing signed by 35 people, all the big ranchers and <br />farmers in this area. We are again requesting for this next hearing that it either be held here so <br />
