FROM : SAN MIGUEL BASIN FORUM <br />Attention Julian <br />Attorney Generals Office <br />NEWS FAX NO. : 970 e64 7856 Nov. 12 2010 03:42PM P1 <br />-L-1- <br />We were ordered by the Division Board to have all witnesses, exhibits, and docurnentation <br />exchanged no later than Monday. I requested an extension because there are no fax machines, no <br />copy machines, no emai Is, no FedEx available on the weekends that I could submit those types of <br />numbers of documents, There are no stores here to purchase copy paper or anything. The closest <br />place is 2,5 hours away which even if I got everything done, there would be no way to have it <br />there by Monday. That was humanly impossible. I wrote and called for an extension. Western <br />Fuels objected profoundly and said there was no reason that I could not have that. Jeff Fugate set <br />the deadline for the 10' at closing of 5:00, no exceptions. Western Fuels did not even send theirs <br />iout until the 10' in the afternoon and we did not receive it until. late yesterday the 11". This is <br />becoming more and more one sided here. <br />' Then Western Fuels sent all of my witnesses letters that look official like court docurnents, <br />stating that I was a liar and all the facts that I have presented have been fabricated and that the <br />teachers, Miss Duffy, Miss Phelps, and Miss Freitag were also dishonest people and helped me <br />fabricate all of this information. This is in- excusable. I will telling the Board this, too. This is a <br />forai hearing that any citizen is suppose to have the right to file objections and comments. <br />My witnesses are afraid that they are now going to be accused of something and all they are <br />trying to say input out soils back and the place back like it was. This is terrible to treat people <br />this way that have lived here there entire lives. I have now contacted OSM and I am having them <br />send (GSM all of this because this should not be permitted. We have done nothing wrong here, <br />they have. <br />I have also submitted thirty five more signatures requesting another formal hearing and <br />requesting again the SKYPF program which allows everyone to appear in person. We have also <br />requested if this is not accepted that the meeting be held in here in Nucla because of all of the <br />farmers and ranchers commitment and a tour of the mine, and that these ranchers and farmers be <br />able to attend because they are the largest ranchers in this country owning 1000's of acres- They <br />have read the findings document as well as seen for themselves the removal of our topsoil and <br />other important information. They all buy hay from me and testify that I am the largest cash crop <br />producer in this area.
