(Colowyo) CDPS Permit No. CO-0045161 <br />Dear Ms. Morgan, <br />Per the message I left you on your phone on May 16, 2011, this letter is to inform you in <br />writing of elevated levels of effluent standards for the month of April 2011. Colowyo Coal <br />Company L.P. sampled Outfall 001A (Streeter Pond), Outfall 004A (Gulch A Pond), and <br />Outfall 007A (Prospect Pond) on April 4, 2011, and laboratory analysis was received on <br />April 18, 2011. The results of the analyses indicated that Outfall 001A exceeded the 35 <br />mg/L 30-Day Maximum Concentration Average for Total Suspended Solids, the 70 mg/L <br />Daily Maximum Concentration Average for Total Suspended Solids with a result of 76 <br />mg/L, and the 1.00mg/L 30-Day Maximum Concentration Average for Total Recoverable <br />Iron with a result of 2.78 mg/L. The results of the laboratory analyses of Outfall 004A <br />indicate that it exceeded the 35mg/L 30-Day Maximum Concentration Average for Total <br />Suspended Solids with a result of 68 mg/L and the 1.00mg/L 30-Day Maximum <br />Concentration Average for Total Recoverable Iron with a result of 5.03 mg/L. The results of <br />the laboratory analyses of Outfall 007A indicate that it exceeded the 1.00mg/L 30-Day <br />Maximum Concentration Average for Total Recoverable Iron with a result of 1.58 mg/L. <br />The samples were retested to ensure that the first results were correct. The reruns showed <br />results that coincided with the original results. Pursuant to Permit Number: CO-0045161, <br />Section A.2. the permittee may seek relief from the TSS limitations if the discharge <br />occurred within 48 hours after measurable precipitation has stopped. Colowyo received <br />measurable precipitation on April 3, 2011, which is within 48 hours of the sampling. <br />Temperatures at Colowyo have been warm, creating snowmelt and runoff of accumulated <br />snowpack in the vicinity of the outfalls. Please see the attached climatological data for <br />additional information <br />In an attempt to meet the 30 day average of 35mg/L for Total Suspended Solids and the 30 <br />day average of 1 mg/L for Total Recoverable Iron, Colowyo Coal Company resampled <br />Outfall 001A and Outfall 004A on April 11, 2011. The results of the analyses indicate that <br />the level for Total Suspended Solids and Total Recoverable Iron dropped to 26 mg/L and <br />0.63 mg/L, respectively, for Outfall 001A. The results of the analyses for Outfall 004A <br />indicate that level for Total Suspended Solids dropped to 12 mg/L, and the level for Total <br />
