Brown, Sandy
From: Brown, Sandy
Sent: Tuesday, May 17, 2011 4:11 PM
To: 'carversix10@yahoo.com'
Cc: Talvitie, Marcia
Subject: FW: New horizion north
Hello Mr. Carver,
The Division of Reclamation, Mining and Safety Rules at 4.15.1(5) and 4.15.7(5)(b) discuss weed control measures to be
conducted on coal mines. Our Rules reference the "Colorado Weed Management Act" and the Guideline for the
Management of Weed Control on Coal Mines (http://www.minins.state.co.us/Forms/NoxiousWeeds.pdf). In the
guideline, the Division recommends multiple control methods depending on the weed species and the extent of
infestation. Chemical controls are allowed and are generally very effective for weed control on mined lands. Other
alternatives include: mechanical, physical, or biological controls. Often, we consult with the county weed agent for their
recommendations. If you are requesting a specific weed management plan, that would need to be negotiated with the
mine operator and the operator would include that in the permit application. The weed management plan is required as
part of the permit application and must be approved in the permit.
Our rules are available on-line at http://www.mining.state.co.us/rulesrees/Coal%20Regulations%209 02014%2005 pdf .
Please let me know if you have further questions.
Sincerely,
Sandy Brown
Sandra L. My name is Roger Carver and I work for western fuels in Nucla. The proposed New Horizion
North expansion plan includes our property. My first question is about weed management, We are looking to
go into organic production in the near future as part of our retirement plan. If we sign a deal with new horizion
does the state have provisions in place for weed and pest management that does not include the use of poisions?
We have worked and at times had to defend ourselves against spray happy folks who believe poision is the
gospel, our land is clean and it's taken a long time to get it that way. Can the state work with us and Western
Fuels towards a new direction in pest management If we are to sign a deal. I see the oppertunity for the state
and Western Fuels and we the land owners to pilot a new greener era of energy production. This also apply's
