The shaft was approved for use as an asbestos <br />disposal shaft by the CDPHE Hazardous Materials and Waste Management Division on <br />September 14, 1988 (copy of CDPHE approval letter attached). The shaft was constructed and <br />configured per our design plan submitted to CDPHE dated July 7, 1988. The ventilation shaft is <br />10 feet in diameter and more than 660 feet deep. The collar consists of a steel liner plate which <br />extends about 70 feet from the surface down through clay, loose boulders and weathered granite <br />into competent bedrock. (Details of the liner are shown in the drawing "CAVR Chronological <br />Section as being Mined by Frontier Const.," Drawing No. 10.6-l, submitted to CDPHE with <br />original application). The remaining 590 feet of the shaft are in bedrock. <br />It is FMI's intent to permanently close the CAVR shaft per the design described in our <br />application letter of July 7, 1988. Per the design plan, the enclosure building will be <br />decontaminated and demolished by a licensed asbestos abatement contractor. As part of these <br />abatement activities, Climax will provide notification to the CDPHE Air Pollution Control <br />Division as part of the asbestos abatement permitting process. After the shaft (and HEPA Fan <br />apparatus) is taken out of service, the surface opening will be plugged and capped to prevent <br />exposure of asbestos containing materials to the atmosphere. The surface will then be graded <br />and prepared to comply with the requirements of Amendment 06 to the Climax reclamation <br />permit issued by the Department of Natural Resources, Division of Reclamation, Mining and <br />Safety (DRMS). Climax will provide CDPHE Solid and Hazardous Waste Division and DRMS <br />with the proposed shaft closure plan for review and approval. The site will be suitably marked <br />so that asbestos will not be excavated in the future, although that scenario is unlikely due to the <br />potential for the shaft being covered with overburden material during haul road construction.
