Request for removal of area from permitted area <br /> <br />Stone Sand & Gravel LLC is requesting the removal of 0.30 acres, as described below <br />and shown on the attached map, from the Permitted Area of Line Camp Pit, <br />Reclamation Permit/File No. M-2001-001. <br />Reason: <br />The pipeline and outfall allowing lowering the water level in the ponds <br />during and after mining was installed in the extreme south "tail" of the <br />permit area; no further work is to be done in this 0.30 acre area and it has <br />been returned to the landowner, who will control water levels in <br />coordination with mining and other activities. The pipeline from Pond #4, <br />and the outfall to the Dolores River is permanent and remains after all <br />mining and reclamation. It is for this reason it is requested to be removed <br />from the permit area, and that will reduce concerns of neighbors. <br />(extracted from Exhibit D/1 of the Amendment <br />This was originally a part of the amendment of the reclamation permit (AM #01) and we <br />understand that a separate set of documentation is necessary. <br />If needed, an affidavit from the surface and materials/mineral rights landowner agreeing <br />to this can be provided. <br />AREA REMOVED <br />The area to be removed is described as (from the same point of beginning <br />as above), <br />Beginning at a point S39°40'00"E a distance of 803.43 feet; <br />Thence, S71 °27'26"E a distance of 35.26 feet; <br />Thence, S21'29'1 7"W a distance of 429.25 feet; <br />Thence, S90°00'00"E a distance of 147.86 feet; <br />Thence, S00°00'00"E a distance of 50.00 feet; <br />Thence, N90°00'00"W a distance of 200.00 feet; <br />Thence, N21 °29'17"E a distance of 579.13 feet; to the point of beginning, <br />Containing 0.30 acres (permitted, affected, and reclaimed), <br />And therefore containing a TOTAL PERMIT AREA of 29.08 acres (permitted <br />and affected). <br />(extracted from Exhibit A of Amendment <br />Landowner name and address: <br />Mr. Duvall Truelsen <br />206 Central Avenue <br />Dolores, CO 81323 <br />IV ED <br />APR 0 5 2011 <br />Durango Field Office <br />Division of Reclamation, <br />Mining and Safety <br />PROJECT: 5006.1-2 Line Camp Pit 5 April 2011, Page 3
