The Division has completed its review of the above referenced report received on 22 Feb 2011. The
Division finds the 2010 Annual Reclamation Report-in compliance of the following Rules:
Rule 2.04.13(1) - Received 22 Feb 2011. Please see comments below.
Rule 2.04.13(1)(a) - The cover of the ARR includes the name of the permittee, the address, and the
permit number.
Rule 2.04.13(1)(b) - The ARR identifies 15.3 new disturbed acres permitted to be disturbed during
calendar year 2010. It is noted that these disturbances were approved through TR-70, TR-73, TR-74,
and TR-76. Due to the inactivity of tasks permitted under TR-73 and TR-76 actual disturbed acres in
2010 is 7.5 acres.
Rule 2.04.13(l)(c) - The ARR identifies 36.2 new backfilled and graded acres during calendar year
2010. It is noted that these acres reflect activities at the 18-Right Shaft, EMD Fan, 18-Left Mine
Water Transfer Pipeline. Please see comments below.
Rule 2.04.13(1)(d) - The ARR identifies 36.2 new topsoiled acres during calendar year 2010. It is
noted that these acres reflect activities at the 18-Right Shaft, EMD Fan, 18-Left Mine Water Transfer
Pipeline. Please see comments below.
Rule 2.04.13(1)(e) - The ARR identifies 36.2 acres which were permanently revegetate- -c wring
calendar year 2010. Please see comments below.
Rule 2.04.13(1)(f) - The location of planting for all previously revegetated areas is listed on page 2 of
the ARR submittal. Please see comments below.
Rule 2.04.13(2) - The following additional information was provided: the Noxious Weed Control
Program activities conducted in 2010, a summary of changes in liability and surety coverage for the
