Loretta Pineda <br />8120 Gage Street Director <br />Fredrick, Colorado 80516 ,? <br />Re: Varra Resources Project 110, File No. M-4984-036, Receipt of 112 Construction Materials <br />Reclamation Permit Amendment (AM-Q2) Application Package - Second Incompleteness s--' <br />Dear Mr. Varra: ?I// <br />On February 15, 2011, the Division of Reclamation, Mining and Safety (Division) received the 112 <br />Construction Materials Reclamation Permit Amendment (AM-02) Application package for the Varra <br />Resources Project 110 site (formerly Dakolios Pit No. 1), File No. M-1984-036. Review of the additional <br />information submitted by the Applicant on March 8, 2011 determined the following items must be <br />received before the Division can consider the application as being submitted and technical review can <br />begin: <br />Application Form: <br />1. On Page 2, Item #9 of the original amendment application form, the Applicant indicated the Quarter <br />Section as "NE". Based on Exhibit A - Legal Description and Exhibit B - Survey Map submitted in the <br />application package and the Division files, the Division believes the proper location information is the <br />"SW" Quarter Section. <br />The Application submitted a revised Page 2 of the application form with the quarter/quarter selection <br />changed from "NE" to "SW", instead of correcting the quarter section location as recommended b <br />the Division. <br />Please review the quarter and quarter/quarter section selections and revise accordingly. <br />The application will not be considered submitted until the information listed above is received and found <br />sufficient to begin our review. A decision date will be established 90 days from the date of receipt of all <br />of the requested information. Additionally, if you have already published notice you will need to <br />republish notice, after the Division considers the application submitted. This notice must be published <br />once a week for four (4) consecutive weeks, starting within ten (10) days of the date your application is <br />considered submitted. We will notify you when you should initiate republication of your notice.
