Pineda <br />Director <br />The Division received your above referenced response in regard to the Compliance Problems <br />cited in the report of the inspection conducted on June 12, 2009. The statuses of the corrective <br />actions regarding these problems are as follows: <br />Compliance Problem 1: Mill tailing discharged to locations outside of approved pond. <br />This problem is considered abated as a result of the Operator's submittal of documentation <br />describing the location of tailings deposition and the approximate volume tailings deposited at <br />each location. The Division may require additional testing to ensure the tailings will not have an <br />adverse impact on groundwater or surface water. Any additional testing or mitigation which may <br />be required by the Division will be addressed under separate cover. <br />Compliance Problem 2: A thin layer of tailings was deposited on the out-slope of the tailing <br />dam. <br />This problem is considered abated as a result of the Operator's submittal of a Tailings Pond <br />Maintenance and Monitoring Plan. <br />Compliance Problem 3: Incorrect Financial Warranty bond form on file. <br />This problem is currently pending resolution. The appropriate bond forms have been provided to <br />the Operator. <br />Compliance Problem 4: The permit boundary was inadequately marked. <br />At the request of the Operator, the corrective action date has been extended to July 31, 2011. <br />Please be aware that no extensions will be granted beyond the July 31, 2011 deadline.
