We received the PR-12 package for Bowie No. 2. Everything looks okay for completeness but it looks like the public
notice has to be revised. A couple of the previous permit revisions also needed to have their public notices revised but I
didn't catch them at the time. Please e-mail a revised public notice. Thanks!
Rule 2.07.3(2)(d) states that written comments, objections and requests for an informal conference should be
on the permit revision public notice. The PR-12 public notice doesn't mention the informal conference. Also, as
stated in other rules, there is a 30 day period from the last publication for comments, objections and requests
for an informal conference. The PR-12 public notice states only 10 days after the date of the publication for
comments.
2. It looks like Rule 2.07.3(2)(e) applies since there will be mining underneath Steven's Gulch Road. If the Terror
Creek road is a public road, then this rule applies to that road as well. The public notice should have a
description of the road portion(s) and a statement indicating the public's right to request a public hearing on the
road issue. Also, the notice should state that there is a deadline of 30 days after the last publication for such
requests and that the hearing would be in the locality of the mine. Please refer to the rule for the exact
requirements.
