We have yet to decide whether to accept the OSM
response or to request an appeal. We may also attempt to provide additional response if allowed.
The OSM response raises an issue regarding the timing of reclamation and standards, and we may not have fully
understood this to be part of the initial allegation. As such, we may not have provided a complete response.
I request that we be provided an extension of time to assess our response, and to either provide a revised response or
file a review with the Regional Director. May we please receive an extension of the five day deadline from February 14,
2011 to February 22, 2011?
We hope to fully address any allegations before it becomes necessary to implement new or additional procedures.
Thank you,
David Berry
