Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Mr. Ray Lazuk <br />Climax Mine Loretta Pineda <br />Director <br />Highway 91- Freemont Pass <br />Climax CO 80429 <br />Re: Follow-up Issues/Information from January 25, 2011 meeting between Climax and DRMS <br />regarding Review of a 112d Metals Reclamation Permit Amendment Application Package <br />AM-06, Climax Mine, Permit No. M-1977-493 <br />Dear Mr. Lazuk: <br />Thank you and the rest of your group for coming to Denver to discuss AM06, I believe it was a useful <br />conversation. As a result of this meeting, there are some additional adequacy issues which the Division <br />would like to see addressed in addition to the items contained in the November 10, 2010 letter. Climax has <br />requested that the decision date for AM06 be extended to March 25, 2011. Please be advised that if you <br />are unable to satisfactorily address any concerns identified in this review before the decision date, it <br />will be your responsibility to request an extension of the review period. If there are outstanding <br />issues that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. In order to allow the Division <br />adequate time to review your responses to any adequacy issues, please submit your adequacy <br />responses to the Division no later than two weeks prior to the decision date (March 11, 2011). <br />Please note that any changes or additions to the application on file in our office must also be reflected in <br />the public review copies, which have been placed with the Lake, Summit and Eagle County Clerk and <br />Recorders. <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): <br />(1) All information necessary to calculate the costs of reclamation must be submitted and broken down into <br />the various major phases of reclamation. You must provide sufficient information to calculate the cost <br />of reclamation that would be incurred by the state. <br />(2) The office may request the operator/applicant to provide additional, reasonable data to substantiate said <br />Operator/Applicant's estimate of the cost of reclamation for all affected lands. <br />With respect to the bond calculation discussion on Jan 25, 2011, DRMS will accept a "clean slate" <br />approach to the Exhibit L calculations in AM06. DRMS will still need comprehensive documentation <br />for the resulting bond amounts, both for existing work to complete, and for reclamation associated <br />with proposed new activity in AM06. Also as we discussed, a list of reclamation tasks that have been <br />completed to-date should be included so we can document for the file work that has been done. Due <br />to the scope and detail of the reclamation estimate, additional meetings between Climax and DRMS <br />may be beneficial to discuss this Exhibit. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
