L*tft <br />SO* <br />Craig, CO <br />81625 <br />RE: Ross Pit, Permit No. M-1990-134, Violation (MV-2010-034) Abated <br />Dear Mr. Bower: <br />On January 13, 2011 the Mined Land Reclamation Board (Board) signed an Order, in which the <br />Board found a violation (MV-2010-034), at the above referenced site, of C.R.S. 34-32.5-109(1) <br />for failure to obtain a reclamation permit prior to engaging in a new operation. A cease and <br />desist order was issued until all corrective actions were completed by the Operator. The Order <br />required that the Operator provide all materials necessary to allow incorporation of all of the <br />land affected by the mining operation into the approved affected area. Additionally, a Civil <br />Penalty of $37,000.00 was imposed, with all but $1,000.00 to be suspended if the Operator <br />complied with the corrective actions by the due date. <br />On January 14, 2011 the Division of Reclamation, Mining and Safety (Division) approved the <br />amendment application (AM-1), which incorporated the lands affected outside the permit area <br />by the mining operation into the approved affected area. <br />On January 18, 2011 the Division received the unsuspended portion of the Civil Penalty <br />($1,000.00) from the Operator. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
