Pineda <br />RE: Bowie No. 2 Mine, Permit No. C-1996-083, Bowie Resources LLC Director <br />Technical Revision No. 69, Ownership Change, Adequacy Review Letter <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Technical Revision No. 69 (TR-69), submitted by Bowie Resources LLC (BRL) for the Bowie No. 2 Mine. In <br />TR-69, BRL proposes a change in the ownership of Bowie Resources LLC whereby L&L Energy Inc will own <br />55% and Cedars Energy, Inc will own 45%. <br />The TR-69 submittal, dated December 9, 2010, was received at the Division on December 10, 2010. The <br />submittal was called complete on December 10, 2010 and the operator published the completeness public notice <br />in the December 15, 2010 edition of the Delta County Independent. The public has until the end of December <br />27, 2010 to submit written comments concerning TR-69. As of the date of this letter, the Division has not <br />received any public comments concerning TR-69. <br />The Division has no specific adequacy review questions concerning TR-69. However, in doing its adequacy <br />review, the Division did a check of the Applicant Violator System (AVS). There were no violations associated <br />with L&L Energy Inc. The Division will conduct additional AVS checks before TR-69 becomes final. <br />The proposed decision to approve TR-69 will not be made until the public comment period has expired, there <br />are no remaining adequacy issues, additional AVS checks are successfully made and evidence is submitted to <br />the Division that L&L Energy Inc has secured part ownership in BRL. The proposed decision to approve TR-69 <br />will be published in the newspaper and will initiate a ten day public comment period. <br />If you have any questions, please let me know. <br />Sincerely, <br />Joseph.
