Specifically, the requested TR releases RMCC from the requirement of installing a <br />"French Drain System" to maintain the iustoric groundwater regime supplying the ditch. <br />On ovem r , 2009 the Division of ec amation, imng and Safety (the <br />Division) approved Amendment 002 (AM-2) to RMCC's Bromley Lakes sand and gravel <br />mining operation. The Division's approval stipulated that: <br />"Ready Mixed Concrete Company shall not disturb the McCann Ditch and land within <br />200 feet of the McCann Ditch until they have submitted and received approval from the <br />Division of a Technical Revision with plans for the French Drain System. * * * The <br />Technical Revision shall contain engineering plans and details about the location of the <br />French Drain System that will be installed to transmit groundwater to the ditch to <br />maintain the groundwater regime supplying the ditch. Also, the operator will need to post <br />sufficient financial warranty to cover the cost of the installation of the French Drain <br />System. <br />OR <br />The operator will need to submit and receive approval of a Technical Revision showing <br />the French Drain System is not necessary. <br />***This stipulation shall not apply to areas mined adjacent to the McCann Ditch <br />originally permitted for relocation under the existing and currently approved mining and <br />reclamation plan.
