Pineda <br />Director <br />RE: East 8th Street, Operation; DRMS File No. M-2000-082 <br />Technical Revision (TR01); Adequacy Review #1 <br />The Colorado Division of Reclamation, Mining and Safety has conducted a review of the technical <br />revision submitted in regards to the above referenced operation. There are several issues that will need <br />to be clarified prior to approval of the technical revision. The decision date for the technical revision is <br />November 29, 2010. <br />Phase 2 Monitoring: <br />1.) The Division approves your request to eliminate the Phase 2 monitoring requirement. However, <br />based on the locations of two wells located to the east and south east of the permit area; owned by Mr. <br />Ed Duggan, groundwater elevation monitoring would be appropriate in this portion of the permit area. <br />Please submit a plan for installing two additional monitoring wells. One well should be located between <br />the phase 3 mining area and Mr. Duggan's northern well. The other well should be located between the <br />phase 3 mining area and Mr. Duggan's southern well. Both wells should be near the permit boundary. <br />Please submit a map indicating the location of these two additional wells. <br />2.) Please submit a basic design for the types of wells that will be installed as described above. Please <br />commit to monitoring these wells on a monthly basis and to submit the results of these measurements <br />in the annual reclamation report. Please indicate if these additional wells will be monitored on a weekly <br />basis for two months during dewatering as is the requirement for the Phase 1 monitoring wells installed <br />along the northern boundary. <br />Mitigation Plan: <br />3.) Aggregate Industries is proposing a complaint/notification based mitigation plan. Please commit to <br />notifying the Division within 24 hours of a complaint the Operator receives related to impacts of the <br />hydrologic balance. With this notification please commit to submitting a report to the Division <br />indicating what measures are being taken to identify the cause of the complaint. <br />4.) If Aggregate Industries operation is found to be a contributing factor to damages of the hydrologic <br />balance it appears several mitigation activities will be pursued as outlined in the letter(s) the Operator <br />sent to wells owners in the vicinity to obtain their gravel well permit. Please commit to notifying the <br />Office of <br />Mined Land Reclamation <br />Denver • Grand Junction • Durango <br />Office of <br />Active and Inactive Mines
