October 27, 201.0 <br />Mr. Jared Ebert AGGREGATE <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety INDUSTRIES <br />1300 Sherman Street, Suite 200 <br />Denver, CO 80203 <br />Re: Permit No. M-2000-082 - East 8t` Street Operation <br />Dear Mr. Ebert: <br />In response to corrective actions set forth in your report on the Division's inspection of the above- <br />referenced operation, conducted March 3 1, 2010, enclosed is a copy of a notarized agreement between <br />Aggregate Industries and Ogilvy Irrigation T,-and Company for affecting land within 200 feet of the <br />Ogilvy Ditch and a copy of a notarized agreement between Aggregate Industries and Colorado <br />Department of Transportation for affecting land within 200 feet of East 8t' Street. With regard to the <br />Greeley Gas Company Marker noted in the inspection report, Aggregate Industries will either enter into a <br />structure damage reimbursement agreement with Greeley Gas Company or submit an engineering <br />evaluation indicating the structure will not be damaged by the operation prior to affecting land within 200 <br />feet of the marker. <br />The only other corrective action required as a result of the March 31 inspection is with regard to <br />submitting a technical revision for an updated groundwater monitoring plan.
