At that time, Climax was uncertain as to whether mine wastes <br />would be disposed within a new repository, in situ, or on one of the existing tailing impoundments <br />within the Affected Land at Climax. In response, you stated that if mine waste would be relocated to an <br />existing tailing impoundment or waste dump within the Affected Lands, your office would require a 30- <br />day notification only. As you are aware, Climax provided such notification and removed mine wastes <br />from the Searle Gulch area to the Mayflower Tailing Impoundment in 2006. <br />Removal and reconsohdation of existing, historic mine wastes is an on going project at Climax. <br />Beginning in mid-July, 2007, Climax will be removing mine wastes from the historic Michigan mine <br />sites (three levels) and depositing these wastes on the Tenmile Tailing Impoundment. <br />If you have any questions or require additional clarifications, please contact me at (719) 486-2150 ext. <br />723. <br />Sincerely, <br />Gary A.
