`TN M , s??
DEPARTMENT OF THE ARMY /
"'. U.S. ARMY ENGINEER DISTRICT, SACRAMENTO V
?• CORPS OF ENGINEERS
1325 J STREET
SACRAMENTO CA 95814-2922
REPLY TO
ATTENTION OF
October 8, 2010
Regulatory Division SPK-1996-75208 R E C E I E11)
OCT 12 2010 /
Mrs. Patricia Farnsworth / GRAND JUNG i,:, ,-ItLu OFFICE
Farnsworth Construction and Gravel Company DIVISION OF
175 Highway 133 RECLAMATION MINING & SAFETY
Paonia, Colorado 81428-9525 _Z-0 ?-/
Dear Mrs. Farnsworth:
We are responding to the August 10, 2010 Colorado Division of Reclamation, Mining, and
Safety Minerals Program Inspection Report for the Farnsworth project. Photographs and
information within the report indicated a potential violation in the North Fork of the Gunnison
River. The project is located at the old Paonia Drive-In Theater within the NE '/4 of Section 1,
Township 14 South, Range 92 West, Sixth Principal Meridian, Latitude 38.8676°, Longitude -
107.61357°, Town of Paonia, Delta County, Colorado.
Based on our September 20, 2010 site visit, Ms. Carrie Sheata of this office investigated the
area and determined there was no unauthorized fill placed with the North Fork of the Gunnison
River. Equipment frequently crosses the river and there was no evidence of recently placed material
on the southeast bank of the river. Prior dealings with our office make you aware of the Corps'
Regulatory program and you know to contact our office with any projects involving the placement
of fill into waters of the United States, including wetlands. Please be aware that dozer blading of
the river to designate an access crossing is a regulated activity.
Please refer to identification number SPK-1996-75208 in any correspondence concerning
this project. If you have any questions, please contact Ms. Sheata at Colorado West Regulatory
Branch, 400 Rood Avenue, Room 134, Grand Junction, Colorado 81501, email
Carrie.A.Sheata@usace.army.mil, or telephone (970) 243-1199, extension 14.
Sincerely,
Susan Bachini Nall
Chief, Colorado West Regulatory Branch
