DCG �� I� -�/ -�8 � III IIIIIIIIIIIIIIII <br />sss <br />• <br />Rule 2.05.5 - Postminine Land Uses <br />(1) Surface Coal Mining Activities <br />(a) Each plan shall contain a detailed narrative of the proposed use, following reclamation of <br />the land within the proposed permit area. In accordance with land use categories established in the narrative, the <br />plan shall include a discussion of the utility and capacity of the reclaimed land to support a variety of alternative <br />uses, and the relationship of the proposed use to existing land use policies and plans. This description shall explain. <br />(i) How the proposed postponing land use is to be achieved and the necessary support <br />activities which may be needed to achieve the proposed land use; <br />(ii) Where a land use different from the premining land use is proposed, all materials <br />needed for approval of the alternative use under 4.16; <br />(iii) The consideration which has been given to staking all of the proposed surface coal <br />mining and reclamation operations consistent with surface owner plans and progratns; and <br />(b) The description shall be accompanied by a cow of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the State and local <br />government agencies which would have to initiate, implement, approve. or authorize the proposed use of the land <br />following reclamation. <br />(c) A map prepared to the standards of 2.10 shall accompany the plan. <br />• RESPONSE <br />TCC is requesting approval for an underground mine with this permit revision application. Therefore, the <br />requirements of this Section are not applicable to the Foidel Creek operation. Details regarding postmining land <br />uses at the Fish Creek Tipple, which is a surface operation, are enumerated within the Fish Creek Tipple Appendix, <br />Volume VII, Rule 2.05.5(1). <br />(2) Underground Mining Activities <br />a) Each olan shall contain a detailed narrative of the proposed use, following reclamation of <br />the land to be affected by all surface operations and facilities within the proposed permit area. In accordance with <br />the land use categories established in the narrative, the plan shall include a discussion of the utility and capacity of <br />the reclaimed land to support a variety of uses and the relationship of the prODosed use to existing land use policies <br />and plans. The description shall explain <br />(i) How the proposed posuninipg land use is to be achieved and the necessary support <br />activities which may be needed to achieve the proposed land use: <br />(ii) Where a land use different from the premining land use is proposed, all materials <br />needed for approval of the alternative use under 4.16: and <br />(iii) The consideration which has been given to making all of the proposed surface <br />mining activities consistent with surface owner plans and applicable State and local land use plans and programs. <br />(b) The description shall be accompanied by a cops of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the proposed permit area and the State and local <br />government agencies which would have to initiate, implement, approte. or authorize the proposed use of the land <br />APPROVE[) APR 2 4 2000 <br />Permit Renewal No. 3 2.05 -123 4/1/99 <br />
