Pineda <br />Director <br />Westminster, CO 80234 <br />Re: New Horizon North Mine (Permit No. C-2010-089) <br />New Application <br />Dear Mr. Shrestha: <br />We have received your new permit application to conduct coal mining in Colorado. Our initial review <br />indicates that all preliminary items required by Rules 2.03, 2.04, 2.05, and 2.06 have not been submitted. <br />Thus, your application is incomplete for the purposes of filing as of October 8, 2010. <br />Maps 2.04.6-2, 2.04.6-3, 2.04.6-4, 2.04.6-5, 2.04.6-6, 2.04.6-7, 2.04.7-1, 2.04.7-2, 2.04.7-3, <br />2.04.7-4, 2.04.7-5, 2.04.7-6, and 2.04.7-7 will need to be resubmitted at a larger scale in order <br />for the Division to be able to adequately conduct a technical review of the information provided <br />on the maps. Rule 2.10.1(1) requires all maps of the disturbed area to be submitted at a <br />minimum scale of 1:6,000. The maps provided by WFC are providing information within the <br />disturbed area and are presented at 1:9,600. <br />2. The public notice submitted by WFC in accordance with Rules 2.03.12 and 2.07.3(2) will need <br />to be modified as follows: <br />The ownership of the land to be affected must be listed in the notice (Rule 2.07.3(2)). <br />The notice provides the address for and directs telephone inquiries -to_the_DRMS Tr_ d <br />Junction office. Please amend the notice to provide the contact information for the <br />Durango office, and state that phone inquiries should be directed to Marcia Talvitie in <br />the Durango office, Division of Reclamation Mining & Safety, Durango Field <br />Office,691 CR 233, Suite A-2 Durango, CO 81301, (970) 247-1184 (Rule 2.07.3(2)(d). <br />Since topsoil stripping and pond construction will be within 100' of the outside right-of- <br />way of a public road, WFC must amend the notice to include a statement indicating that <br />a public hearing, for the purpose of determining whether the interests of the public and <br />affected landowners will be protected, may be requested by contacting the Division in <br />writing within 30 days of the last publication of the notice, and that any such hearing <br />would be held in the locality of the proposed mining operation (Rule 2.07.3(e)). <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
