Corrective Action Response. <br />Dear Mrs. Davis, <br />The Division of Reclamation, Mining and Safety (Division) received your letter dated September 29, <br />2010. The Division reviewed the letter and has identified several issues that will need to be addressed in <br />order to consider the corrective actions resolved originally cited in the March 31, 2010 inspection report. <br />Ogilvy Ditch: <br />1.) The Division understands a signed agreement is in negotiation with the ditch company. Per your <br />request the Division will grant an extension to submit a signed notarized agreement for the Ogilvy Ditch <br />by October 30, 2010. <br />East 8th Street: <br />2.) A copy of the engineering evaluation conducted by Haley & Aldrich, Inc. is not on file with the <br />Division. If a structure damage reimbursement agreement cannot be obtained from CDOT, Aggregate <br />Industries will need to submit an updated engineering evaluation to account for the current stockpiling <br />activity at the site and the future mining plan per Rule 6.4.19 and Rule 6.5. The Division will give the <br />Operator until October 30, 2010 to submit either a notarized structure damage reimbursement agreement <br />or a technical revision for the engineering evaluation. <br />Greeley Gas Company Marker: <br />3.) Upon review, the Division concurs with your evaluation. Prior to affecting land within 200 feet of this <br />structure, the Operator must submit and receive approval of a notarized structure damage reimbursement <br />agreement from the Division. Or, Aggregate Industries must submit and receive approval of a technical <br />revision with an appropriate engineering evaluation indicating the structure will not be damaged by the <br />mining operation. <br />Ground Water Monitoring Plan Technical Revision: <br />4.) The Division approves your request for an extension to submit a technical revision for the updated <br />groundwater monitoring plan.
