As you are probably <br />aware, the responses to the issues of how much soil will be replaced, the seed mix to be utilized, and type and quantity of <br />fertilizer are either missing or entirely inadequate. The map provided also does not meet ANY of the requirements for a <br />submitted exhibit for either mining plan map or reclamation map. <br />The Division has attempted to work with you since June 2009 to bring your site back into compliance. We've gone over <br />the requirements for this revision several times in detail, both over the phone and in person, and we've provided you with <br />a hard copy of the construction materials rule for reference. We are not asking you for any more information than is <br />required for every other permitted operation in the State, yet you have still failed to submit anything on time, or <br />approvable by the Division. <br />You are therefore required to submit to the Division - IN APPROVABLE FORM - the following items by October 13, <br />2010: <br />1) How much soil will be replaced on the site during reclamation? 4" or 6"? Your initial submittal listed both <br />depths... <br />2) You stated that you would use manure as a soil amendment prior to seeding. How much per acre do you plan to <br />use? <br />3) You will provide a suitable rangeland seed mix to be used for reclamation that specifies each species to be seeded, <br />and the amount of each species in pounds of pure live seed per acre to be applied. <br />4) You will provide new Mining Plan and Reclamation Maps that satisfy ALL the requirements outlined in sections <br />6.2, and 6.3.5 of the rule which I have attached with this letter. <br />If you fail to submit this information in an approvable form by October 13, 2010 this revision will be denied and another <br />RTB letter will be sent by the Division to schedule yet another hearing for the November 2010 MLRB meeting for failure <br />to comply with the corrective action in July's signed Board order. <br />Eric Scott - Environmental Protection Specialist <br />Certified mail# 7008 3230 0002 7253 3054 <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
