AGENCY: <br />NA None None <br />WEATHER: IN CT R'S <br />GNATURE: SIGNATURE DATE: <br />Clear 2 September 10, 2010 <br /> <br />The following inspection tonics were identified as havine Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH: THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: Mining at the Headley site has been complete for over five years and the Operator <br />has failed to complete reclamation. Rule 3.1.3 states that all reclamation shall be carried to completion within five years from the date <br />the Operator informs the Division that mining is complete. <br />CORRECTIVE ACTIONS: The Operator shall complete reclamation of the site in accordance with the approved Reclamation Plan by <br />the corrective action date. The Operator shall notify the Division upon completion of reclamation and shall request an inspection of the <br />site. <br />CORRECTIVE ACTION DUE DATE: 8/25/11 <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator no longer owns the portion of the mine site which lies on the west side <br />of County Road 31 and has failed to provide an updated source of the legal right to enter the property as required by Rule 6.4.14. <br />CORRECTIVE ACTIONS: The Operator shall provide the Division with a source of legal right to enter the property located on the <br />west side; of County Road 31. This may be a copy of an access lease or a signed statement by the Landowner and acknowledged by a <br />Notary Public stating that the Operator/Applicant has a legal right to enter and mine. The source of the legal right to enter the property <br />must be received by the Division on or before the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 10/08/10 <br />INSPECTION TOPIC: Reclamation Success <br />PROBLEM/POSSIBLE VIOLATION: Problem: Trash and refuse was noticed on the site. This is a problem at this time for failure to <br />dispose of refuse in a manner that controls unsightliness or deleterious effects of such refuse pursuant to C.R.S. 34-32.5-116(4)(e). <br />CORRECTIVE ACTIONS: The operator shall submit a written notice to the Division with photo documentation, that the trash has <br />been removed from the site by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 10/08/10 <br />Page 1 of 18 <br />
