Everist, Inc., I will respond to <br />your April 30, 2010 adequacy review letter in the order and <br />number format presented in that document. <br />Exhibit C - Pre-Mining and Mining Plan Maps (Rule 6.4.3) <br />The Division understands that the locations and configuration of some future structures (such as concrete batch <br />plant and conveyor belts) is not currently known, and that it will be several years before they are constructed on <br />site. A Technical Revision will be required at a later date to add any of these structures/features and provide <br />details not specifically included at this time. Also be aware that placing structures of any kind, including <br />excavations and reservoirs, in the designated flood plain will be subject to approvals from Weld County and <br />FEMA (conditional letter of map revision, etc.) There will also be bonding implications for the removal of any <br />structures placed on-site. <br />We would like to avoid having to do a Technical Revision as <br />mining resumes to add the Concrete and Asphalt Batch Plants. <br />However, at this time the exact location of the concrete and <br />asphalt plants within the Plant Site are unknown. To resolve <br />this I have provided sketches of the typical layout of each <br />plant within a plant envelope (Adequacy Exhibits AD-1, AD-2, & <br />AD-3). The location of each plant envelope would be within <br />the Plant Site area shown to the Mining Plan Map but the exact <br />location of each plant will be governed by the need as <br />operations resume and the flexibility when laying out the <br />plant site as needed at that time. <br />According to FEMA, equipment associated with mining operations <br />are not considered structures and therefore do not need to be <br />elevated. The plants proposed are temporary facilities, and <br />if flooding occurred would not be impacted by the water as. <br />only the supports would be underwater and water would flow <br />a_. iii-69196
