Dear Mr. Gagliano,
The Division has identified several other comments and questions that must be addressed prior to
the Division's decision due date. Please be advised that if you are unable to satisfactorily
address any concerns identified in this review before the decision date, it will be your
responsibility to request an extension of the review period. If there are outstanding issues
that have not been adequately addressed prior to the end of the review period, and no
extension has been requested, the Division will deny this application.
6.4.3 Exhibit C - Pre-mining and Mining Plan Map(s) of Affected Lands
1. The Mining Plan Map does not list the owners of the permanent man-made structures. Rule
6.4.3(g) states the map must show the owner's name, type of structure, and location of all
significant, valuable, and permanent man-made structures contained on the area of affected
land and within two hundred (200) feet of the affected land. Please revise the Mining Plan
Map to show the owner's of the permanent man-made structures.
6.4.5 Exhibit E - Reclamation Plan
2. The Applicant has stated the existing service gravel road will be upgraded to accommodate
heavier loads. Please confirm if the service road will remain upon the completion of
reclamation.
3. The Applicant has chosen to bond for backfilling of the pit, as indicated in. "Exhibit L -
Reclamation Costs", instead of bonding for construction of the reservoir. The Applicant
should be aware the Division will implement the alternate reclamation plan in the event of a
permit revocation and bond forfeiture. In order for the Division to approve the alternate
reclamation plan, the Applicant must provide some additional detail:
a) Please specify the seed mix to be used on the backfilled (reservoir) area.
