Pineda <br />8120 Gage Street <br />Frederick, Colorado 80516 <br />RE: Dakolios Pit; DRMS File No. M-1984-036; Technical Revision -04 Adequacy Review #2 <br />Dear Mr. Janes, <br />The Colorado Division of Reclamation, Mining and Safety (Division) received your response to our first adequacy <br />review of Technical Revision 04. The Division has reviewed the information submitted, and has several items that <br />will need clarification prior to the Division's approval. The decision date for the Technical Revision is August 4, <br />2010. If you need additional time to address the Division's concerns, you must request an extension of the <br />decision date. <br />Item #1-- Agricultural Area: <br />1.) During the 1996 Technical Revision (TR-02) process, the Operator did request to backfill a large portion of the <br />northern lake with inert material. Part (e) of the inert fill notice states the backfilled lake will create a level surface <br />suitable for agriculture, and the Operator committed to capping the inert backfill with two feet of overburden of <br />which, six inches of this material was designated as soil. Thus, the Operator should have saved enough overburden <br />and growth medium on the site to fulfill their commitment. The Division will not approve the request to leave <br />areas 1 and 3; as delineated on the submitted reclamation plan map, un-topsoiled and not revegetated. <br />Areas 1 and 3 were measured to be about 34 acres total. These areas will need to be capped with an appropriate <br />amount of overburden and growth medium to establish vegetation. Please submit a revised map indicating these <br />areas will be re-soiled and revegetated. <br />As of now, the Operator is required to cap the remaining 34 acres with two feet of material as described above (18 <br />inches of overburden and 6 inches of topsoil). There is not enough topsoil/growth medium on the site to fulfill the <br />re-soiling requirement. It is unclear if overburden has already been backfilled in portions of these areas. Please <br />indicate which areas have been capped with overburden, if any, and identify the location of any overburden piles <br />located on the site and an estimate of their volume. Please provide an estimate of the amount of overburden and <br />topsoil that will need to be imported into the site to fulfill the Operators commitments. The financial warranty will <br />need to be increased in order to cover the cost of importation of this material. <br />Another option as discussed in the first adequacy review is to withdraw this Technical Revision and submit an <br />amendment to the permit and update the reclamation plan outlining the intended use of these areas. <br />Item #2 -- Clay liner of the Northwest Pond: <br />2.) Based on our conversations and the Technical Revision narrative, the Office of the State Engineers (SEO) leak <br />test for the clay liner is pending for the northwestern pond.
