AGENCY: <br />N/A None None <br />WEATHER: INSPEC R'S S A SIGNATURE DATE: <br />Cloudy July 23, 2010 <br />v <br />The followine inspection topics were identified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: During the inspection, it was observed that above ground storage tanks at the site <br />have no secondary containment and petroleum products had spilled onto the soil throughout the area. This a problem related to C.R.S. <br />34-32.5-116 (4) (h) for failure to minimize impacts to the prevailing hydrologic balance. <br />CORRECTIVE ACTIONS: Submit a final report to Division containing the following information: <br />1. A description about how the spill was cleaned up and the appropriate photo documentation. <br />2. Evidence in the form of a receipt that the contaminated soil was disposed of by an approved method (such as sent to an approved <br />landfill, land farming, recycling center, etc.). <br />3. Install secondary containment for the tanks and supply the Division with documentation of this activity. <br />4. Submit a copy of the approved Spill Prevention Control and Countermeasure Plan (SPCC). <br />CORRECTIVE ACTION DUE DATE: 8/13/10 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator has not complied with Stipulation No. 1 of the Amendment 01 <br />approval for utility line crossing while constructing the slurry wall. The Operator has not submitted the required notarized documents in <br />accordance with Rule 6.4.19 (a) and Rule 6.4.19 (c) or obtained Division approval of an engineering plan. This is a problem at this time <br />for failure to follow the approved mining plan. Pursuant to C.R.S. 34-32.5-112 (1) (c) (VI). <br />CORRECTIVE ACTIONS: Submit evidence the notarized agreements were obtained for the slurry wall crossings prior to when the <br />slurry wall was installed. <br />CORRECTIVE ACTION DUE DATE: 8/13/10 <br />Page 1 of 12 <br />
