The ERWSD and UERWA comprise the <br />second largest municipal water provider on the West Slope, serving approximately 60,000 <br />customers in Eagle County, with a service area that extends from the Town of Vail to Wolcott. <br />These entities represent some of the major water users and water providers in Eagle County. <br />Our clients are concerned about the proposed amendment to the Climax Mine permit, and <br />hereby request party status and an opportunity to be heard at a formal hearing before the Mined <br />Land Reclamation Board ("Board"). ERWSD and UERWA are shareholders in the Eagle Park <br />Reservoir Company ("Reservoir Company'), and may be directly and adversely impacted by the <br />proposed mining activities, including adverse impacts to the prevailing hydrologic balance of the <br />affected lands and of the surrounding area, and to the quantity and quality of surface and ground <br />water. As set forth in the July 8, 2010 letter from the Reservoir Company, incorporated herein <br />by this reference, the proposed amendment to the mining permit may harm the Eagle Park <br />Reservoir. That potential injury is also potential injury to the Reservoir Company's <br />shareholders, including ERWSD and UERWA, who rely on the water stored in the reservoir. <br />39520
