OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Reclamation Success <br />PROBLEM/POSSIBLE VIOLATION: Stockpiles of fill dirt and rip-rap have been imported into the site against the current approved <br />reclamation plan. This is a problem at this time for failure to follow the approved reclamation plan, pursuant to C.R.S. 34-32.5-116 (1). <br />CORRECTIVE ACTIONS: The Operator must submit a signed notarized affidavit from the landowner indicating they wish the fill <br />dirt material to remain on the site for their own personal use and a commitment not to sell this material. For the rip-rap material <br />stockpiled at the site, the Operator will need to submit evidence indicating this material will be used for the stated armoring activity <br />along Boulder Creek. A copy of the Army Corp of Engineers permit would suffice along with a cover letter explaining the proposed <br />activates. <br />CORRECTIVE ACTION DUE DATE: 8/9/2010 <br />Page 1 of 6
