OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a Possible <br />Violation is indicated, you will be notified under separate cover as to when the Mined Land Reclamation <br />Board will consider possible enforcement action. <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />OBSERVATIONS: <br />PROBLEM/POSSIBLE VIOLATION: Problem: Current site conditions and maps submitted with annual reports do not <br />match the approved permit area. Some of the excavation, particularly in the northwest portion of the permit area, appears to <br />fall outside the approved permit area. <br />CORRECTIVE ACTIONS: A map prepared by a registered land surveyor, professional engineer, or other qualified <br />person must be submitted to DRMS that shows the current site conditions along with the approved DRMS permit boundary. <br />CORRECTIVE ACTION DUE DATE: 8/30/2010 <br />INSPECTION TOPIC: Other <br />OBSERVATIONS: <br />PROBLEM/POSSIBLE VIOLATION: Problem: A small stockpile of coal (less than approximately 50 cubic yards) was <br />observed on site during the inspection. The Operator indicated that this material is imported from a nearby coal mine, <br />processed on site, and sold. This is not currently approved by the DRMS permit. <br />CORRECTIVE ACTIONS: The Operator must gain permission to crush coal on site through submission and approval of <br />a Technical Revision to the DRMS permit. <br />CORRECTIVE ACTION DUE DATE: 8/30/2010 <br />Page I 1
