Applegate <br />Group, Inc. ?- - <br />June 22, 2010 <br />Mr. Eric Scott <br />Environmental Protection Specialist <br />Division of Reclamation, Mining, and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Acreage Release Request; Jake Kauffman & Son, Inc.; <br />Wagner/Kauffman Pit #3; M-99-069 ? <br />Mr. Scott: <br />"AR ?s <br />'N.232010 <br />k"vis+4n of Reci &W.,. <br />Mining and Safety <br />The following information is being submitted on behalf of our client, Jake Kauffman & Son, Inc. <br />The Wagner/Kauffman Pit #3 mining operation (M-99-069) is located mainly in the Northwest '/4 <br />of the Northwest'/4 of Section 21, Township 5 North, Range 68 West of the 6th P.M. The site is <br />located in Larimer County' approximately 1.5 miles east of Loveland, Colorado. <br />Phase I of the mining operation covers the east half of the permit area,, with approximately 102 <br />total acres permitted. Mining in Phase I is essentially complete. Reclamation activities have <br />been concurrent with mining progression, and approximately 67 acres of Phase I have previously <br />been released by the State following past acreage release requests. <br />During a partial release inspection performed by DRMS on May 26, 2010, an area of land within <br />the current permit boundary near the southwest corner of Phase I was identified as undisturbed <br />from its natural state. This 9.6 acre portion of the permitted area contains a stand of 50+ year old <br />cottonwood trees which act to provide habitat for a colony of blue herons. Disturbances in this <br />area have been avoided over the life of the gravel pit with the intent of maintaining the habitat <br />value therein. <br />Similar to the release you assisted us with in May 2010, Jake Kauffman & Son, Inc. is requesting <br />the additional release of the aforementioned 9.6 acres of the Phase I area. A reduction in the <br />permit financial warranty is NOT being requested.
