STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
June 17, 2010
Kathleen G. Welt
Mountain Coal Company, LLC
P.O. Box 591
Somerset, CO 81434
Re: West Elk Mine (Permit No. C-1980-007)
Technical Revision No. 121(TR-121)
MDWs E3-71, 75, 76, 78, and E4-76, 81, 82, 83, Adequacy Review
Dear Ms. Welt:
COLORADO
D I V I S I ON OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
Governor
James B. Martin
Executive Director
Loretta E. Pifi da
Director
DRMS has the following comments regarding your response letter of June 11, 2010, with comments numbered the same as
in your letter and our letter of June 10, 2010.
1. DRMS has provided the requested copy of the SBPO response since receiving your letter.
2. Carl Johnston of OSM explained in a phone call to DRMS today that no further federal fish and wildlife clearance is
needed for the work proposed in TR-121.
3. No further comment is necessary at this time, as USFS right-of-entry is pending.
4. Rule 2.10.2(1) allows DRMS to require a map to show relevant information, for good cause shown, based on site-
specific condition. Preparing the cost estimate for TR-121 will require reconciling previously proposed E-Seam
MDWs (and associated roads and pads) with those that have actually been drilled. The submitted table of 2008-10
MDW drilling shows identification (i.d.) numbers for some of the completed MDWs that are not shown on any map in
the permit application. An updated map showing current locations and i.d. numbers for all E-Seam MDWs that have
been drilled (and the locations of their associated roads and pads) would aid preparation of the TR-121 cost estimate.
Rule 2.03.3(1) requires information in the application to be current, clear, and concise. Rule 2.10.1(1) requires a map
that shows all facilities in the permit area. To ensure compliance with Rules 2.10.1(1) and 2.03.3(1), and as allowed by
Rule 2.10.2(1), please provide the previously requested map that includes current locations and i.d. numbers for E-Seam
MDWs that have been drilled and that are proposed for drilling. Also, please revise the submitted table of 2008-10
MDW drilling to show the same MDW W. numbers as those proposed in TR-121 (for example, the table shows MDW
E3-76.5, but TR-121 proposes MDW E3-76).
To reconcile the information in the table titled "TR-121 Project Details" with the information on the map titled "E
Seam MDW Drilling Plan", please add MDW E-3 to the table.
6. DRMS has completed its previously mentioned research and finds Mountain Coal Company's response to this comment
is adequate.
Sincerely,
7-? le--
Tom Kaldenbach
Environmental Protection Specialist
cc: Dan Hernandez, CDRMS
Office of
Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
