Pineda <br />Director <br />On April 28, 2010, the Division sent you a letter requesting an additional warranty in the amount of, <br />$30,764.00, for a total of $70,685.00, based on the 2008 inspection report within 60 days or by June 28, <br />2010. Your site was also inspected while in the area inspecting the DFC ceramics site M-1991-143. The <br />operators of the DFC ceramics site asked you to look at their operation, since your company showed <br />some interest in succeeding the Ceramics 110 site. <br />The Division had sent the DFC ceramics site an inspection report based on the findings of the site visit to <br />increase the warranty from the current $5,000.00 to $15,000.00, if the site was not succeeded by <br />November 30, 2010. Since that time Robinson Brick has agreed to succeed the DFC Ceramics site permit <br /># M-1991-143 and at a later date submit an amendment to incorporate the entire permit area to the <br />adjacent Robinson brick 112 permit site (M-1991-003.) <br />Since the two operations permit areas are contiguous, the incorporation of the permit area into the 112 <br />operation is. possible. If Robinson Brick submits the additional warranty in the amount of $30,764.00, no <br />later than August 28, 2010, the Division will allow Robinson Brick to only submit the current $5000.00 <br />that is held for permit #M-1991-143, when the succession of operation application is submitted. The <br />Division will not require Robinson Brick the additional warranty, for the revision. When the permit <br />amendment revision is submitted, to incorporate the two permits, the Division requests Robinson brick <br />to limit the disturbance associated with both permits not to exceed 20 acres at any given time, without <br />the appropriate revision to the permit.
