Box 100 <br />Eads, Colorado 81036 <br />Re: Follow-up on Unresolved Problem(s) at the Peters Pit, DRMS File No. M-1991-078 <br />Dear Mr. Scott: <br />The above-mentioned site has had one or more problems noted that, according to Division of Reclamation, <br />Mining and Safety (Division) records have not yet been resolved. According to our records, the following <br />problem(s) was (were) to be resolved on or before November 30th, 2009 as listed on the October 19th, 2009 <br />inspection report sent to your office. Listed below are descriptions and corrective actions for the problem(s). <br />Please resolve the corrective actions and provide evidence of such resolution on or before July 3e, 2010. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to the Division by <br />the date provided above, the listed problems could be escalated to the level of possible violations and would then <br />be referred to the Mined Land Reclamation Board for further action. <br />PROBLEMS CITED: <br />1.) The Operator has disturbed the topsoil stockpile during the mining operation and will likely continue to <br />disturb portions of the topsoil stockpile. This is a problem at this time for failure to store topsoil <br />stockpiles in a location where it will not be disturbed by the ongoing mining operation. Pursuant to Rule <br />3.1.9 <br />a. Corrective action: Relocate portions of the topsoil stockpile that currently intersect the highwall <br />and/or are very close to the highwall that may be disturbed by the ongoing mining operation. The <br />topsoil will need to be relocated within the approved permit boundary. Submit a notice to the <br />Division when this has been complete with a narrative describing what actions occurred and <br />photographic evidence of such activity. Also, please display the new location of the topsoil on the <br />mining plan map. <br />If the problem(s) has(have) already been remedied, please provide evidence of its(their) completion.
