Re: Follow-up on Unresolved Problem(s) at the Peters Pit, DRMS File No. M-1991-078
Dear Mr. Scott:
The above-mentioned site has had one or more problems noted that, according to Division of Reclamation,
Mining and Safety (Division) records have not yet been resolved. According to our records, the following
problem(s) was (were) to be resolved on or before November 30th, 2009 as listed on the October 19th, 2009
inspection report sent to your office. Listed below are descriptions and corrective actions for the problem(s).
Please resolve the corrective actions and provide evidence of such resolution on or before July 3e, 2010.
Please note that if the corrective action(s) are not properly addressed, and evidence provided to the Division by
the date provided above, the listed problems could be escalated to the level of possible violations and would then
be referred to the Mined Land Reclamation Board for further action.
PROBLEMS CITED:
1.) The Operator has disturbed the topsoil stockpile during the mining operation and will likely continue to
disturb portions of the topsoil stockpile. This is a problem at this time for failure to store topsoil
stockpiles in a location where it will not be disturbed by the ongoing mining operation. Pursuant to Rule
3.1.9
a. Corrective action: Relocate portions of the topsoil stockpile that currently intersect the highwall
and/or are very close to the highwall that may be disturbed by the ongoing mining operation. The
topsoil will need to be relocated within the approved permit boundary. Submit a notice to the
Division when this has been complete with a narrative describing what actions occurred and
photographic evidence of such activity. Also, please display the new location of the topsoil on the
mining plan map.
