Pineda <br />Oak Creek, CO 80467 Director <br />RE: Twentymile Coal Company, LLC, Permit C-1982-056 <br />Revised Decision Forms RN-5 and MR-243 <br />Dear Mr. Nettleton, <br />In the process of reviewing liability amounts, the Colorado Division of Reclamation, Mining, and <br />Safety (CDRMS) has found that a slight discrepancy in the Foidel Creek Mine's liability amount. The <br />error occurs from the RN-05 decision which affects the MR-243 decision form. It appears that the <br />change in liability amount of $1,636,842.96 approved on the June 4, 2010 Proposed Decision form is <br />incorrect. The actual change in liability for RN-05 should be $1,199,789.92 resulting in a Revised <br />Liability of $9,760,543.96 as indicated in the RN-05 Bond Calculation. <br />This discrepancy in our system resulted in the approved liability amounts for MR-243 to be higher than <br />liability required. The revised decision forms for the above mentioned revision are attached. These <br />forms reflect the new liability amounts required for the Foidel Creek Mine's reclamation bond. <br />If you have any questions feel free to contact me.
