As has been the <br />case over the past several years, these individuals exemplify litigious behavior. Each and every subject <br />initiates large quantities of legal correspondence from attorneys. This past summer, members of Polycor <br />management traveled to Arizona to meet with the Mclntyres to attempt to reach common ground as well <br />as understand the dilemma. We have reached the conclusion that their animosity is derivative of old <br />feelings and emotions, and, further, no logical settlement can nor will resolve their "issues." <br />Nonetheless, our primary interest is to clear-up any doubts. You have requested our response which is <br />as follows: <br />RE: "Additional Permit Area Wrongfully Includes Dedicated Public Trail" <br />Colorado Stone Quarries still addresses trails issues with a legal team In conjunction with Gunnison County, and <br />wants to point out the fact that our current Reclamation Permit already includes a substantial part of the Public Trail. <br />There is no change In extending our Reclamation Permit area to a zone that includes the Public Trail. <br />RE: "Amendment Wrongfully includes Mclntyres' Private Property for Quarry's Sediment Control and <br />Drainage without Acquiring Legal Right of Entry" <br />Confusion is likely the case in this instance. Map will be clarified to show precisely that the amended Reclamation <br />Permit and related Sedimentation Control Plan do not overlap the boundaries of the Mclntyres' private property. <br />RE: "Amendment Seeks to Continue. Wrongful Dumping of Marble Waste" <br />Colorado Stone Quarries consistently works on developing new markets for its by-products. This is intended to limit <br />the presence of marble by-products by removing them from the site. <br />Also, as discussed amongst the "parties" during the site visit on May 21, 2010, operations will not be <br />limited between June and September 2010, but will be predictable throughout the year.
