Martin <br />Executive Director <br />RE: Notice of Formal Public Hearing for Nuvemco, LLC, 112d-1 Permit Application <br />for the Last Chance Mine, Permit Application No. M-2008-012. <br />Dear Party and/or Interested Person: <br />On April 14, 2009 Nuvemco, LLC submitted a 112d-1 application for the Last Chance Mine. Per Rule <br />1.4.1(9) at the request of the Applicant, the review time for an application may be extended and the <br />decision date reset, not to exceed 365 days from the date the application was filed. The additional <br />time may be requested to allow the Applicant an opportunity to provide information necessary to <br />meet the adequacy requirements of the Office. If, at the end of the 365 day period, the application has <br />outstanding adequacy issues, the Office may set the matter for a Board hearing. At the hearing the <br />Board may deny, or approve the application with or without conditions. <br />As of April 15, 2010 Nuvemco, LLC still had outstanding review issues that needed to be addressed. <br />Therefore, staff has scheduled the matter for a Formal Public Hearing before the Colorado Mined Land <br />Reclamation Board, for consideration. The hearing for consideration of the application for the Last <br />Chance Mine will occur during the June 9-10, 2010 Board meeting at 1313 Sherman Street, Room 318, <br />Denver, Colorado, commencing at 9:00 a.m. or as soon thereafter as the matter can be considered. <br />Parties and interested persons will have the opportunity to be heard. <br />If you need additional information, please contact Russ Means at the Division of Reclamation, Mining, <br />and Safety, Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, <br />telephone no. 970.241.1117. <br />Sincerely, <br />A 4d*-- <br />G.
